A criminal case has been initiated for the submission of a fake FOS decision

The Inquiry Department of the Russian Ministry of Internal Affairs for the City of Essentuki initiated a criminal case at the request of the Ombudsman for financial services consumers support Service (OFSC). The investigation is underway according to Part 3 of Article 30, Part 1 of Article 159.5 of the Criminal Code against «Fraud in insurance». The reason for the initiation of the criminal case was an unidentified person providing a fake Financial Ombudsman’s decision to an insurance organization, Head of the OFSC Olga Kraynova said.

This article provides for the punishment of imprisonment for up to six years plus a fine of up to eighty thousand rubles.

At the beginning of 2020 the OFSC revealed the fact of forgery of the Financial Ombudsman’s decision which actually had never been taken. Moreover, the applicant, whose details were specified in the forged document, had never appealed to the Financial Ombudsman Service. The beneficiary’s representative sent an email with a fake decision to the insurance company in order to obtain an MTPL insurance indemnity, which the Financial Ombudsman had allegedly decided to recover.

On the fact of the incident, the OFSC appealed to law enforcement agencies for the purpose of prosecution of the persons who had made and emailed the fake Financial Ombudsman’s decision to criminal liability.

In this regard, the bill, which was introduced to the State Duma of the Russian Federation and which provides for the direction of the financial ombudsman’s certificate to the FSSP of Russia exclusively in an electronic form signed by a strengthened qualified electronic signature of the Ombudsman for the rights of consumers of financial services, is becoming essential, Olga Kraynova emphasizes. «The adoption of the bill will allow, among other things, to exclude such undisguised facts of fraud, when unscrupulous persons present forged documents on behalf of the FOS, as well as to exclude abuse on the part of unscrupulous claimants,» Olga Kraynova says.
