The issue contains information about the FOS activities, comments on the matters of out-of-court dispute resolution, and analytical materials on consideration by the Financial Ombudsman Service of the appeals of consumers of financial services.
In his column in the new issue, Chief Financial Ombudsman Yury Voronin talks about the peculiarities of dealing with disputes in non-motor types of insurance. Olga Kraynova, Head of the Ombudsman for financial services consumers support Service (OFSC), contributes to the Bulletin with a discussion of the accounting for depreciation under CMTPL contracts and the FOS practice on the matter. Lyudmila Senkina, Director of the Control of Insurance Activities Department of the All-Russian Union of Insurers and Analytical Director of the Russian Association of Motor Insurers (RAMI), shares her experience in dealing with consumer claims in the unions and also notes the positive impact of the institution of out-of-court dispute resolution.
The Bulletin publishes a review on the practice of challenging the Financial Ombudsman’s decisions and the Financial Ombudsman Service’s suggestions for changes to the legal and regulatory framework, the need for which was identified in the course of this work. In particular, disclosed are the issues of penalties collection by the Financial Ombudsman, and appeals against the Financial Ombudsman’s decisions by the parties of the dispute. The topics of recovery of expenses on emergency commissioners by a consumer, recovery of compensation of moral damage by a consumer, recovery of third parties’ fees from financial institutions for consideration of a dispute by the Financial Ombudsman are examined.
